Firewood Sales Terms & Conditions
Timberline Forestry LLC
Effective Date: January 1, 2026 · Last Updated: August 18, 2026
These Terms and Conditions ("Terms") govern the sale and delivery of firewood products by Timberline Forestry LLC, a Colorado limited liability company ("Timberline," "we," "us," or "our"). By placing an order with us — whether by phone, in person, online, through an invoice payment, or any other means — you ("Customer," "you") agree to these Terms in full.
These Terms apply only to firewood product sales. They do not cover wildfire mitigation, forest health assessments, hazard tree removal, or any of our other forestry services, which are governed by separate service agreements.
Please read these Terms carefully before placing an order. If you do not agree with any part of these Terms, do not place an order.
1. About Firewood as a Natural Product
Firewood is a natural product cut from real trees. It is not a manufactured or standardized good. As a result, every cord we deliver will have natural variation in color, bark coverage, knot patterns, piece size within standard ranges, and species mix. These are inherent characteristics of firewood and are not considered defects.
Our firewood is locally sourced beetle-kill spruce and pine from the San Luis Valley, seasoned before delivery. We do not carry oak or hardwood species, which are not native to the region we serve.
If we are out of stock of a specific product when fulfilling your order, we may substitute a comparable product of equal or greater value at our discretion, or contact you to reschedule.
2. Orders, Pricing & Payment
2.1 How to Place an Order
Orders may be placed by phone at (719) 316-9101, by email at info@timberlineforestry.com, in person, or through any order form on our website. An order is not confirmed until we have acknowledged it and you have received an invoice.
2.2 Pricing
Current firewood pricing — including per-delivery pricing, pickup pricing, seasonal subscription pricing, and commercial & volume pricing — is published on our website at timberlineforestry.com/services/firewood. The pricing displayed on our website at the time your order is confirmed and paid is the pricing that applies to your order.
Delivered firewood is priced in two ways. Our base delivered price is for drop-off (dump) delivery, in which we deliver your cord and dump it in an accessible spot you specify — delivery is included in this price. Hand-stacking is an optional add-on priced separately, per cord, as published on our website. If you want your wood stacked, the stacking add-on is charged in addition to the base delivered (drop-only) price. See Section 3.3 and Section 3.4.
Prices are subject to change at any time without individual notice to customers. Pricing fluctuates with supplier costs, diesel costs, and seasonal demand. We do not provide individual notice to past or prospective customers when pricing changes. The current published pricing on our website is the authoritative source.
Price lock for subscriptions and commercial accounts. Customers who sign a seasonal subscription agreement or commercial volume agreement have their per-cord rate locked at the rate stated in their written agreement for the full duration of that agreement, regardless of subsequent website price changes.
2.3 Payment Terms — Per-Delivery and Pickup (One-Off) Orders
Payment for one-off firewood orders — whether for delivery or pickup — is due in full before delivery is made or the firewood is staged for pickup. The invoiced amount includes the base delivered (drop-only) price plus any stacking add-on and any other options you have selected. Payment may be made by paying your Square invoice online or by providing payment by phone. We will not load, dump, stack, dispatch your order, or stage your firewood for pickup until payment has been received and confirmed.
2.4 Payment Terms — Subscription and Commercial Accounts
Subscription and commercial customers may have alternative payment schedules as set forth in their written agreement (for example, per-delivery billing across the season, or scheduled installments). Specific payment terms will be stated in your agreement.
2.5 Sales Tax
Firewood is subject to applicable Colorado state and local sales tax. We collect sales tax based on the destination of your delivery as required by Colorado destination-based sourcing rules. For customer pickup orders, sales tax is collected based on the pickup location (see Section 4.8).
Colorado sales tax on firewood varies based on how the firewood will be used:
- Residential rate: Bulk firewood (1/4 cord or more) delivered to a residence for use in that residence is exempt from the 2.9% Colorado state sales tax under Colorado Revised Statutes § 39-26-715(1)(a)(II). County and municipal taxes may still apply depending on the jurisdiction.
- Non-residential rate: Firewood sold in smaller quantities (under 1/4 cord), for camping or recreational use, for commercial properties (hotels, restaurants, short-term rentals used as amenities), or for any other non-residential use is subject to the full combined state and local sales tax rate.
Current rates by location:
| Delivery or Pickup Location | Residential Rate | Non-Residential Rate |
|---|---|---|
| South Fork (inside town limits) | 2.60% | 9.50% |
| South Fork (unincorporated Rio Grande County) | 2.60% | 5.50% |
| Del Norte (inside town limits) | 4.60% | 7.50% |
| Del Norte (unincorporated Rio Grande County) | 2.60% | 5.50% |
| Creede (inside city limits) | 6.60% | 9.50% |
| Creede (unincorporated Mineral County) | 2.60% | 5.50% |
| Pagosa Springs (inside town limits) | 5.00% | 7.90% |
| Pagosa Springs (unincorporated Archuleta County) | 4.00% | 6.90% |
The applicable rate will be determined based on your specific use of the firewood and shown on your invoice prior to delivery or pickup. Tax rates are set by the State of Colorado and local taxing authorities and are subject to change at any time as those authorities change them.
3. Delivery
3.1 Delivery Scheduling
During peak season (October through February), we ask that orders be placed at least 2-3 weeks in advance. We do our best to accommodate last-minute requests but cannot guarantee availability during heavy demand periods. Subscription customers receive priority scheduling and guaranteed supply throughout the season.
Delivery dates and time windows are good-faith estimates, not guarantees. Any timeframe we quote — including any "5 to 7 business day" estimate — reflects our best expectation at the time of your order, based on current inventory and weather. Weather, road conditions, equipment availability, and other circumstances may require us to reschedule. We will make reasonable effort to communicate scheduling changes promptly.
Two things commonly extend our delivery timeframe, and neither is grounds for cancellation or refund:
Weather and moisture standards. All of our firewood is verified to under 20% moisture content with a moisture meter before it leaves our operation. We will not deliver wood that does not meet this standard. During periods of rain, snow, or wet conditions, we may hold a delivery until the wood can be delivered at or below our moisture standard and until roads and your access are safe. Protecting the quality you paid for sometimes means waiting on the weather.
Availability and sourcing. Any availability we quote is a good-faith estimate of what we expect to have on hand. We source firewood in batches from a regional supplier; if your order requires a supply run or inventory runs behind current demand, delivery may take longer than the initial estimate.
3.2 Delivery Service Area
We deliver to South Fork, Del Norte, Creede, Pagosa Springs, and the surrounding Rio Grande National Forest region. Extended delivery to other areas may be available — contact us to discuss pricing based on your location.
3.3 Drop-Off (Dump) Delivery Is Standard — Stacking Is an Optional Add-On
Firewood is delivered in a dump trailer. Our standard delivered service is drop-off (dump) delivery: we deliver your order and dump it in an accessible location you specify. Hand-stacking is available as an optional add-on for an additional per-cord fee, as published on our website, and is not included in the base delivered price.
The Customer is responsible for telling us, before delivery, whether they want drop-off (dump) delivery only or delivered-and-stacked service. If we are not informed in advance, we will default to drop-off (dump) delivery in a reasonable location near your point of property access, and no stacking add-on will be charged.
- Drop-off (dump) delivery: The Customer must specify where the load can be dumped. The location must be accessible by our delivery truck, on reasonably level ground, and clear of obstructions, vehicles, pets, and people.
- Delivered-and-stacked service: For the published per-cord stacking add-on, we dump the load at the nearest reasonable, accessible location and then hand-carry and stack the wood at a spot you designate, subject to the distance limit in Section 3.4. The Customer must ensure clear, safe, and unobstructed access to the stacking location before the delivery truck arrives.
3.4 Stacking Service — Distance Limit
Where you have purchased the stacking add-on, we stack by hand-carrying wood from the point where it is dumped, and we will not carry wood more than 10 yards from that point. Firewood is delivered in a dump trailer. We dump the load at the nearest reasonable, accessible location and then carry the wood by hand to your stacking spot. That spot must be within 10 yards of where the wood is dumped. This is a hard limit. If the requested stacking location exceeds 10 yards from where we can reasonably and safely dump — or if access involves stairs, steep grades, or other obstructions that materially increase the labor — we may at our discretion:
- Stack the wood at the nearest reasonable location within the 10-yard limit;
- Leave the load as a drop-off (dump) delivery at the accessible dump location; or
- Charge an additional fee for the extended labor, agreed upon before stacking begins.
The stacking add-on covers reasonable hand-stacking within the limit above. It does not include carrying wood indoors, into basements or upper floors, into enclosed structures, or across terrain our team judges unsafe. Where a requested stacking arrangement falls outside the standard service, we will discuss options and any additional fee with you before proceeding.
3.5 Delivery Access Requirements
The Customer is responsible for ensuring that the delivery location can be safely reached by our truck. This includes:
- Driveways and access roads that can support a loaded delivery vehicle;
- Adequate overhead clearance (no low branches, wires, or structures);
- Adequate width clearance for the vehicle;
- Sufficient turning room to safely exit the property;
- No unrestrained pets, livestock, or people in the delivery path or stacking area;
- Snow-cleared and reasonably ice-free access during winter months.
If our driver determines, in their sole judgment, that the delivery cannot be completed safely — including damage risk to the property, the vehicle, or any person — we may refuse to make the delivery and reschedule, convert to drop-off (dump) delivery at an accessible location, or charge a mobilization fee as described in Section 6.
3.6 Inspection and Acceptance at Delivery
Firewood is delivered in a dump trailer. Before we dump your order (and stack it, if you have purchased the stacking add-on), you (or your representative) have the opportunity to view the load in the trailer and confirm that the quantity matches what you ordered. Our cord is measured to the standard 128 cubic feet (4 ft × 4 ft × 8 ft), and the load in the trailer reflects that measurement.
By allowing us to proceed with dumping (and stacking, if added), you confirm that you have had the opportunity to verify the quantity and that the order is accepted as delivered. Once the load has been dumped (and stacked, if added), quantity is deemed accepted. Concerns about a defect in the wood itself are handled separately under the 24-hour claim process in Section 7.
If you will not be present at delivery, we will deliver to your specified location and the order is accepted on delivery. We recommend being present so you can view the load before it is dumped.
3.7 Delivery Acceptance Confirmation
When we schedule your delivery, we will ask you to add a short comment to your Square invoice confirming your order and your acceptance of delivery — for example: "I approve and accept the delivery of the firewood I ordered." This confirmation records that you authorized the charge, ordered the product, and accepted delivery of the firewood.
Providing this confirmation is part of completing your order. It does not waive your rights under the 24-hour quality claim process in Section 7, but it does document your acceptance of the order and delivery for the purpose of preventing unwarranted payment disputes (see Section 12).
4. Customer Pickup Orders
4.1 Pickup as a Fulfillment Option
Some firewood products are offered for customer pickup as an alternative to delivery. Pickup pricing reflects the absence of delivery. Stacking is a delivery-only add-on and is not offered on pickup orders; pickup orders are self-load (see Section 4.5). Products offered for pickup and current pickup pricing are published on our website.
4.2 Pickup Location
Pickup locations may vary depending on operational needs, product availability, and staging requirements. The specific pickup address for your order will be provided to you by Timberline at the time of order confirmation and will be stated on your invoice. By placing a pickup order, you agree to pick up your firewood at the location designated by Timberline for your specific order.
4.3 Scheduling & Confirmation
The Customer must confirm their intended pickup day with Timberline in advance. We ask that you call (719) 316-9101 before driving to the pickup location to confirm that the firewood is staged and ready. Specific pickup time windows within each day will be communicated to the Customer at the time of order confirmation. Firewood will not be staged for pickup until payment has been received in full.
4.4 Customer Vehicle Requirements
The Customer is solely responsible for bringing a vehicle adequate to safely transport the firewood quantity being picked up, including:
- Adequate cargo capacity for the volume and weight of firewood ordered;
- Appropriate tie-downs, straps, or load securement equipment;
- Safe and roadworthy vehicle condition;
- Valid registration, insurance, and a licensed driver.
Timberline assumes no responsibility for vehicle damage, mechanical failure, accidents, or any other incident resulting from the Customer's transport of the firewood after pickup. If a Customer arrives with a vehicle that is inadequate for the order quantity, the Customer may need to make multiple trips, bring additional vehicles or trailers, or reschedule. Multiple pickup trips do not entitle the Customer to a refund or reduction in price.
4.5 Self-Loading — Customer Loads Own Vehicle
Pickup orders are self-load only. The Customer is responsible for loading their own vehicle. Timberline does not provide loading assistance, equipment, personnel, or supervision during pickup loading.
The Customer assumes all risk associated with self-loading, including but not limited to:
- Personal injury (including back strain, splinters, cuts, drops, and falls);
- Damage to the Customer's vehicle (including interior, paint, body, tires, tailgate, and suspension);
- Loss or damage to firewood during loading;
- Property damage to or near the pickup location during loading;
- Any other incident occurring during the loading process.
Customers under the age of 18 must be accompanied by a parent or legal guardian who will perform the loading. Customers with physical conditions that may make self-loading unsafe should request delivery instead.
4.6 Curbside Staging & Risk of Loss
For Customer convenience, firewood will be staged curbside or at the designated pickup spot in advance of the Customer's arrival.
Once firewood has been staged at the pickup location, the Customer assumes all risk of loss, theft, or damage to the staged firewood. Timberline is not responsible for theft of staged firewood by third parties, damage from weather, or any other incident affecting the firewood between the time it is staged and the time it is picked up by the Customer.
Customers are strongly encouraged to pick up firewood promptly after staging confirmation.
4.7 Pickup Window & Abandoned Firewood
Firewood will be staged for pickup for a period of seven (7) days from the date payment is received unless otherwise agreed in writing. If the Customer has not picked up the firewood within seven days of staging, Timberline reserves the right to consider the firewood abandoned and reclaim it for resale, without refund or credit to the Customer.
4.8 Sales Tax on Pickup Orders
For pickup orders, Colorado sales tax is collected at the rate applicable to the pickup location, regardless of where the Customer resides or where the firewood will ultimately be used. The combined sales tax rate for our standard pickup location in unincorporated Rio Grande County is 5.5% (Colorado state 2.9% plus Rio Grande County 2.6%). If a pickup is staged at an alternate location, the applicable combined tax rate for that location will apply and will be shown on your invoice.
4.9 No Refunds Once Loaded
Once firewood has been loaded into the Customer's vehicle and removed from the pickup location, the sale is final and no refunds will be issued except as may be available under the quality claim provisions of Section 7.
5. Cancellations & No-Refund Policy on Paid Orders
5.1 Per-Delivery and Pickup (One-Off) Orders
Once payment is received on a one-off firewood order — whether for delivery or pickup — the sale is final and non-refundable.
This policy reflects the operational reality of firewood orders: once payment is received, we begin committing to your order. We schedule your delivery and, where needed, make a supply run to our regional supplier and reserve and load wood specifically for your delivery truck load or pickup staging, often the day before delivery or pickup. That commitment of product, fuel, and equipment time cannot be undone. Cancelling a paid order after that work has begun wastes the fuel, equipment time, and product committed to your order.
By paying your invoice, you are confirming you are ready to receive the firewood and committing to the delivery or pickup.
If circumstances change before you have paid your invoice, please contact us as soon as possible and we will release the order without obligation.
5.2 Seasonal Subscription Orders
Seasonal subscriptions represent a season-long commitment from the Customer to Timberline, and a corresponding commitment from Timberline to reserve, source, and stage firewood specifically for that Customer's scheduled deliveries across the season.
Seasonal subscriptions are non-cancellable once the subscription agreement is signed and the season has been scheduled.
Because we source and stage wood to meet the total committed volume of all subscription customers, a mid-season cancellation creates wood inventory we cannot reasonably reallocate. The discounted subscription pricing is offered specifically in exchange for the Customer's full-season commitment.
Subscription customers may, in cases of legitimate hardship (such as a property sale, medical emergency, or other major life event), contact us to discuss the situation. Any accommodation is at our sole discretion and may include rescheduling deliveries, transferring the subscription to another property, or partial accommodation, but is not guaranteed and is not a refund.
5.3 Commercial & Volume Accounts
Commercial and volume account terms — including any cancellation, modification, or non-performance provisions — are governed by the specific written agreement signed by both parties. In the absence of agreement-specific terms, the per-delivery and pickup cancellation policy in Section 5.1 applies to individual deliveries and pickups, and the subscription non-cancellation policy in Section 5.2 applies to the seasonal commitment as a whole.
6. Failed Deliveries & Mobilization Fees
A "failed delivery" occurs when our truck arrives at the delivery address but the delivery cannot be completed. If the failed delivery is due to circumstances within the Customer's control — including but not limited to inaccurate address information, blocked or inaccessible driveways, unsafe conditions, unrestrained pets, no specified dump location, or any other condition that prevents safe completion — we reserve the right to:
- Charge a mobilization fee to cover the round-trip labor, fuel, and equipment time of the attempted delivery;
- Reschedule the delivery for an additional fee; or
- Convert the delivery to drop-off (dump) only at an accessible location.
Mobilization fees are determined based on the delivery zone (which reflects round-trip mileage) and the size of the original order. The fee will be communicated to the Customer before any rescheduling or additional charges are applied.
If the failed delivery was caused by an error on our part — incorrect scheduling, equipment failure, or driver error — no mobilization fee will be charged, and we will reschedule the delivery at no additional cost.
7. Quality Concerns & Claim Process
We stand behind the firewood we deliver and provide for pickup. If you believe there is a legitimate issue with your order — such as incorrect quantity, incorrect product, or a defect in the wood itself — you must follow the procedure below.
7.1 24-Hour Claim Window
All quality concerns and claims must be submitted within 24 hours of delivery or pickup.
Claims submitted more than 24 hours after delivery or pickup will not be considered, because after that point we cannot verify the condition of the wood as delivered or staged, how it was handled, where it was stored, or whether any portion has been used.
7.2 How to Submit a Quality Concern
- Contact us immediately within 24 hours of delivery or pickup by phone at (719) 316-9101 or email at info@timberlineforestry.com.
- Provide your order details: name, delivery or pickup address, delivery or pickup date, and a clear description of the issue.
- Submit clear photographs showing the concern (for example, quantity, condition, foreign material).
- Allow inspection if we determine that an on-site inspection is necessary to verify the claim. Do not move, use, burn, or otherwise disturb the firewood until the claim is resolved.
7.3 Resolution
Upon receiving your claim, we will review the information, conduct an inspection if needed, and respond within a reasonable time. If we determine that the firewood does not match what was ordered, we will, at our sole discretion, either:
- Deliver replacement product to correct the issue;
- Issue a partial refund proportional to the issue; or
- Issue a full refund.
Approved refunds are typically processed within seven to ten business days through the original payment method.
8. Non-Refundable Situations
For clarity, refunds will not be issued in the following circumstances:
- Any paid one-off delivery or pickup order (see Section 5.1).
- Any subscription cancellation (see Section 5.2).
- Pickup firewood that has been loaded into the Customer's vehicle and removed from the pickup location (see Section 4.9).
- Customer failure to pick up firewood within the designated pickup window — abandoned firewood (see Section 4.7).
- Damage to firewood or to the Customer's vehicle, person, or property occurring during customer self-loading (see Section 4.5).
- Theft, weather damage, or other loss of firewood after it has been staged for pickup (see Section 4.6).
- Firewood that has been moved, stacked by the Customer, burned, used, or otherwise significantly disturbed after delivery or pickup.
- Claims submitted more than 24 hours after delivery or pickup.
- Subjective preferences about the wood, including bark coverage, color variation, knot pattern, piece-to-piece size variation within normal ranges, or species ratio within a mixed cord, that do not affect the wood's function as firewood.
- The Customer choosing drop-off (dump) delivery rather than the paid stacking add-on, or declining the stacking add-on — drop-off delivery is the standard service and is not a defect.
- Delivery delays caused by weather, moisture-standard holds, road closures, fire restrictions, supplier lead time, equipment availability, or other circumstances beyond our reasonable control.
- Customer unavailability, inaccessible delivery location, or any other condition preventing successful delivery (mobilization fees may apply — see Section 6).
- Customer arriving at the pickup location with an inadequate vehicle, including any additional trips required as a result.
- Change of mind, change of need, or change of circumstance after the order has been paid or delivery or pickup has been completed.
9. Limitation of Liability
To the maximum extent permitted under Colorado law, Timberline Forestry LLC's total liability for any claim arising out of or related to a firewood sale — whether in contract, tort, warranty, or any other legal theory — is limited to the amount the Customer paid for the specific firewood order in question.
Timberline is not liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost use, property damage beyond the delivery or pickup itself, loss of heating, or any other consequential loss arising from delayed, defective, or failed firewood delivery or pickup.
Nothing in these Terms is intended to limit any right that cannot lawfully be limited under Colorado law.
10. Warranty Disclaimer
Except for the specific commitments stated in these Terms, all firewood is sold "as is." To the maximum extent permitted by Colorado law, Timberline disclaims any and all other warranties, whether express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
The Customer is responsible for the safe storage, handling, transport, and burning of all firewood, including but not limited to maintenance of stovepipes and chimneys, safe stacking practices, safe vehicle loading and transport, fire safety compliance, and adherence to all applicable local fire restrictions and burn bans (see Section 11 for additional information regarding fire restrictions).
11. Fire Restrictions & Burn Bans
11.1 Firewood Sales Continue During Fire Restrictions
Colorado regularly issues fire restrictions and burn bans during periods of elevated wildfire risk. These restrictions limit certain outdoor burning activities but do not prohibit the sale, delivery, transport, storage, or indoor use of firewood.
Timberline continues to sell and deliver firewood during all fire restriction levels — including Stage 1 and Stage 2 restrictions — as the sale of firewood is not regulated by these orders.
11.2 Customer Responsibility for Compliance
The Customer is solely responsible for understanding and complying with all applicable fire restrictions, burn bans, and burn permits in effect at the location where the firewood will be used, including but not limited to:
- Federal fire restrictions (U.S. Forest Service, BLM lands);
- State fire restrictions issued by Colorado authorities;
- County fire restrictions issued by the local Sheriff's Office;
- Municipal fire restrictions and ordinances;
- HOA rules, campground policies, or property-specific restrictions;
- Air quality burn restrictions.
Fire restriction status changes frequently and varies by jurisdiction. Before using any firewood for open fires, campfires, fire pits, or any outdoor burning, the Customer must verify the current restrictions at the intended use location.
Current fire restriction information for our service area:
- Rio Grande County (South Fork, Del Norte): riograndecounty.colorado.gov/departments/office-of-emergency-management
- San Luis Valley regional fire restrictions: slvemergency.colorado.gov/plan-prepare/be-informed/fire-restrictions
11.3 Permitted Uses During Fire Restrictions
Even during active fire restrictions, firewood may generally be used for:
- Indoor wood stoves and fireplaces with proper chimneys;
- Indoor pellet stoves;
- Heating purposes inside enclosed structures;
- Other uses specifically permitted under the current restriction order.
Customers are responsible for confirming the specific permitted and prohibited uses under the restriction order in effect at their use location.
11.4 Customer Liability for Improper Use
If a Customer uses firewood in violation of any applicable fire restriction, burn ban, or fire safety law or regulation, the Customer assumes all liability for that use. Timberline Forestry LLC is not responsible for any fines, civil liability, criminal liability, property damage, personal injury, wildfire damage, or other consequences resulting from the Customer's improper or illegal use of firewood.
The Customer agrees to indemnify, defend, and hold harmless Timberline Forestry LLC, its members, employees, agents, and contractors from any and all claims, damages, losses, fines, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or related to the Customer's use of firewood in violation of any fire restriction, burn ban, or fire safety law or regulation.
11.5 No Cancellation or Refund Right Due to Fire Restrictions
The imposition, modification, or continuation of fire restrictions does not create any right to cancel an existing paid order, modify an order, or receive a refund.
Customers who order firewood that they cannot immediately use due to fire restrictions may store the firewood for use after the restriction is lifted, for use in permitted ways such as indoor stoves or fireplaces, or for use at locations outside the restricted area. Fire restrictions are a known and recurring condition in Colorado and are not considered grounds for refund under any circumstance.
12. Chargebacks & Payment Disputes
We accept credit and debit card payments through Square. By placing and paying for an order, you agree that the process below governs any concern about your order, and that you will use it before initiating a chargeback or payment dispute with your card issuer.
If you have any concern — quantity, product, condition, or billing — you agree to first contact us directly at (719) 316-9101 or info@timberlineforestry.com and allow us a reasonable opportunity to resolve it through the quality claim process in Section 7. Most concerns can be resolved quickly and directly.
You agree not to initiate a chargeback or card dispute for an order you have ordered, authorized, and accepted delivery of. A chargeback is not a substitute for the claim process in these Terms. Disputing firewood that was ordered, paid for, delivered, and accepted — including firewood you confirmed acceptance of on your Square invoice (Section 3.7) and had the opportunity to inspect at delivery (Section 3.6) — is an improper dispute.
If a chargeback is filed, you authorize Timberline to respond to your card issuer with documentation of the transaction, including your invoice, your delivery acceptance confirmation, delivery records and photographs, these Terms, and any communications regarding your order. Nothing in this section limits your legitimate rights under applicable law or your card issuer's rules in cases of genuine fraud or unauthorized charges.
13. Governing Law
These Terms, and any sale of firewood between Timberline Forestry LLC and any Customer, are governed by the laws of the State of Colorado, without regard to its conflict of laws principles. Any legal proceeding arising under these Terms shall be brought in a court of competent jurisdiction located in Colorado.
14. Changes to These Terms
We may update, modify, or revise these Terms at any time without individual notice to past or current customers. The version of these Terms posted on our website at the time your order is confirmed and paid is the version that governs your order. We encourage Customers to review these Terms before placing each order. The "Effective Date" and "Last Updated" dates at the top of this document indicate when the Terms were last revised.
15. Entire Agreement
These Terms, together with the pricing posted on our website and any signed subscription or commercial agreement, constitute the entire agreement between the Customer and Timberline Forestry LLC regarding the sale of firewood. No verbal statement, marketing material, or other written communication modifies or replaces these Terms unless explicitly stated in a written agreement signed by both parties.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
